Ark Teaching Schools Hub (Ark TSH) is a venture of Ark Schools. Ark is a network of 39 schools in the UK, in Birmingham, Hastings, London and Portsmouth. This notice details how your personal data will be used and processed when Ark TSH is acting as an ‘Appropriate Body’ for the purpose of Early Career Teacher (ECT) Induction. For the purposes of processing under Data Protection law, Ark Schools is the ‘Data Controller’ and Evolution Internet Ltd, ECT Manager is the ‘Data Processor’. The Type of Personal Data We Collect The personal data we process relates to individuals who are registered with, or work for, Ark TSH as the Appropriate Body for ECT induction. Personal data that we may collect, use, store and share (when appropriate) about individuals will depend on their role in the process, and may include, but is not restricted to: - Personal Identifiers (e.g., name and date of birth) - Contact information - Teacher status (e.g., QTS/EYTS, Induction Status, ITT result) - Qualified Teacher Status information - Employment details (e.g., current employer) - Name of previous schools at which ECT induction was served - Start date of induction - Qualifications (training information) - Record of completing ECT induction training - Evidence of induction training (e.g., lesson observation form, meeting notes and actions, Teacher standards evidence forms) Some information collected and used is classified under data protection as special category data and include information such as - Ethnicity - Trade union membership - Health, including number of days absence during ECT induction How We Get Personal Data and Why We Have It Most of the personal information we process is provided to us directly by an ECT on completion of the sign-up process through ECT Manager. The purpose of processing this data is to allow Ark TSH to ‘claim’ (register) early career teachers on the Teaching Regulation Agency (TRA) portal for our Teaching School Hub’s Appropriate Body. We will use the data shared with us on ECT Manager to quality assure schools’ early career teachers induction programmes, progress reviews and formal assessments of early career teachers. This information will be used to inform the Teaching Regulation Agency of our decision on whether an Early Career Teacher has passed their induction. Our Lawful Basis for Data Processing Ark TSH operates under the statutory provisions which support the NQT induction process under Part 3 of the Education Act 2011, Section 9 ‘Requirement for teachers in England to serve induction period’ 135A to 135 C and carries out its work in the public interest, also known as ‘Public Task’. The statutory guidance for newly qualified teacher induction provides additional details about managing statutory induction periods. How We Store This Data and How Long Personal data is stored and backed-up by Evolution Internet Ltd (ECT Manager) on servers located in the UK every six hours and then encrypted and backed up daily off-site. We will retain your personal data for as long as it is necessary to fulfil the purposes of processing. ECT Manager will retain data for six years after the date of completion of induction in line with the statutory recommended minimum period. After six years the data will be permanently deleted from the ECT Manager system and cannot be retrieved. Data Sharing and Retention We share this information with the Teaching Regulation Authority (TRA) where it is used to maintain the central list of outcomes of statutory mandated newly qualified teacher (NQT) induction periods. This information is made available by the TRA to relevant employers within the education sector so they may check the eligibility of an individual to teach in England. Most of the data provided through ECT manager will not be shared with the TRA and will remain securely within the Manager system, to help us make our decision on whether an Early Career Teacher has met the Teaching Standards (e.g., no termly reports are shared with the TRA). Ark TSH share the necessary data with the TRA through an automated process through ECT Manager using industry standard encryption. Ark TSH will share the following data with the Teaching Regulation Agency: - Teacher Reference Number - Personal Identifiers (e.g., name and date of birth) - Induction Period Start and End Date (date of pass or date of leaving establishment) - Induction Outcome (Pass or Fail) - Induction Period Number of Terms (number of assessment periods completed) However, should the decision of the completion of induction in a ECT’s final assessment go to an Ark TSH or TRA panel, following the recommendation from a Headteacher that an ECT has not performed satisfactorily against the Teaching Standards, data will be shared with the panel members including termly reports and outcomes. Ark TSH will inform the relevant Local Authority (LA) of the names of schools where an ECT is teaching in Years 2 and 6 to enable them to meet their statutory duties for assessment and moderation. No ECT’s personal data will be shared when informing the LA. Transferring Data Internationally No personal data is transferred outside of the UK. Automated Decision Making Automated decision making is not used when processing data. Your Data Protection Rights Under data protection law, you have rights including: - Right of Access - You have the right to ask us for copies of your personal information, also known as a Subject Access Request. - Right to Rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. - Right to Erasure - You have the right to ask us to erase your personal information in certain circumstances. - Right to Restriction of Processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. - Right to Object to Processing - You have the the right to object to the processing of your personal information in certain circumstances. - Right to Data Portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances. You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
